GHOSTBOND Academy — Intellectual Property and Anti-Piracy Policy

This Policy forms part of the GHOSTBOND Academy Terms and Conditions.

1. Ownership

1.1 All Academy Content — including video, audio, text, images, curricula, methodologies, workbooks, templates, protocols, assessments, badges and software — is owned by or licensed to Professional Hair Products Limited, a company registered in Ireland under number 497664, and is protected by copyright, database right, trade mark and other intellectual property laws worldwide.

1.2 GHOSTBOND, GHOSTBOND Academy, Professional Hair Labs, Scientific Cosmetix and associated logos and course names are trade marks of Professional Hair Products Limited, which is the registered proprietor of the registrations listed at clause 1.4 and the owner of the unregistered rights and goodwill at clause 1.5.

1.3 Nothing in your purchase transfers ownership of any intellectual property to you. You receive only the limited licence at clause 10 of the Terms and Conditions.

1.4 Principal registered trade marks. The marks below are registered in the name of Professional Hair Products Limited and are the marks principally relied on in enforcement. This is a summary of the principal registrations; the full portfolio comprises over 180 registrations and applications across more than 30 jurisdictions and is available to enforcement authorities and platform operators on request.

1.5 Unregistered rights. GHOSTBOND Academy, ATELIER by GHOSTBOND and the Academy course titles are used as unregistered trade marks and are protected by the law of passing off, unfair competition and copyright. Nothing in this Policy is a representation that any particular mark is registered in any particular territory.

1.6 Licence to Scientific Cosmetix LLC. Scientific Cosmetix LLC uses the marks under licence from Professional Hair Products Limited. All goodwill arising from that use accrues to Professional Hair Products Limited.

2. What Counts as Piracy

2.1 The following are material breaches and, in most jurisdictions, unlawful:

1. recording, screen-capturing, filming or re-streaming Academy Content;
2. uploading Academy Content to any file host, cloud drive, torrent, Telegram or WhatsApp group, Discord server, social platform, or any course-sharing or “leaked course” site;
3. selling, renting, bartering or giving away Academy Content or access to it;
4. sharing or selling account credentials, or operating a shared or “group buy” account;
5. reproducing our curriculum, module structure, protocols or workbooks in your own training material;
6. using Academy Content to build or deliver a competing course or certification;
7. removing or defeating watermarks, DRM, session limits or other technical protection measures; and
8. using Academy Content to train or develop any artificial intelligence or machine learning system.

3. Technical Protection Measures

3.1 We apply, and reserve the right to apply, measures including:

1. forensic and visible watermarking carrying a unique per-user identifier;
2. concurrent-session and registered-device limits;
3. encrypted, tokenised video delivery;
4. download and right-click restrictions;
5. geographic and IP anomaly detection; and
6. automated web and marketplace monitoring for leaked content.

3.2 Data generated by these measures is processed as described in clauses 3.10 and 5 of the Privacy and Data Collection Policy.

3.3 Circumventing or attempting to circumvent any of these measures is prohibited and may itself be a criminal offence under copyright legislation, including Article 6 of Directive 2001/29/EC and 17 U.S.C. § 1201.

4. Consequences of Infringement

4.1 Where we identify infringement we may, in any combination and without prior notice where the infringement is manifest:

1. suspend or permanently terminate the account, without refund;
2. revoke any certificate under the Certification Policy;
3. issue takedown notices to hosts, platforms, marketplaces, payment providers and search engines;
4. refer the matter to a trade mark or copyright enforcement action;
5. claim damages, an account of profits, delivery up and injunctive relief;
6. recover our investigation and legal costs where the law permits; and
7. report the matter to law enforcement or a customs authority where criminal or counterfeiting conduct is involved.

4.2 Forensic watermarking allows us to trace leaked content to the originating account. The account holder is responsible for all activity under their account, including where they claim credentials were shared or compromised.

5. Reporting Infringement of Our Rights

5.1 If you find GHOSTBOND Academy content, marks or products being used without authorisation, please tell us at hello@ghostbondacademy.com. Include a link, a screenshot and any seller or account details.

5.2 Reports may be made confidentially.

6. Reporting Infringement of Your Rights — Notice and Takedown

If you believe content on the Academy platform infringes your copyright or other rights, follow the procedure below.

6.1 What to include in a notice

1. your name, address, telephone number and email address;
2. identification of the work you say is infringed, with evidence of ownership or authority to act;
3. identification of the material you say is infringing, with a URL or precise location sufficient for us to find it;
4. a statement that you have a good faith belief that the use is not authorised by the rights holder, its agent or the law;
5. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the rights holder; and
6. your physical or electronic signature.

6.2 Where to send it

6.3 What we will do

We will acknowledge receipt, assess the notice promptly and in a diligent, objective and proportionate manner, remove or disable access to the material where the notice is valid, notify the user who posted it with a statement of reasons, and inform you of our decision.

6.4 Counter-notice

If your content was removed and you believe it was removed in error or by misidentification, you may submit a counter-notice containing:

1. your name, address, telephone number and email address;
2. identification of the material removed and its location before removal;
3. a statement, under penalty of perjury, that you have a good faith belief it was removed as a result of mistake or misidentification;
4. for US counter-notices, your consent to the jurisdiction of the Federal District Court for your district (or, if outside the US, the Middle District of Florida) and your agreement to accept service from the complainant; and
5. your signature.

We will forward the counter-notice to the complainant. Where the law provides for it, we may restore the material after 10 to 14 business days unless the complainant notifies us that they have filed court proceedings.

6.5 Appeals

Users in the EU may appeal a removal decision under clause 6 of the Acceptable Use and Community Guidelines, and may refer a dispute to a certified out-of-court dispute settlement body under Article 21 of Regulation (EU) 2022/2065.

6.6 Misuse

Knowingly submitting a materially false notice or counter-notice may result in liability for damages and costs. We may suspend handling of notices from any person who repeatedly submits manifestly unfounded ones.

7. Repeat Infringers

7.1 We maintain and enforce a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright or other intellectual property rights.

7.2 Two upheld infringement findings within any 12-month period will ordinarily result in permanent termination without refund.

8. Counterfeit Products

8.1 GHOSTBOND products are subject to a parallel counterfeit enforcement programme, including product authentication codes.

8.2 Promoting, selling, recommending or using counterfeit, decanted, refilled or relabelled product represented as GHOSTBOND is a breach of these Terms, the Acceptable Use and Community Guidelines and the Certification Policy, and will result in termination and certificate revocation.
